If you are a foreigner and need to incorporate your company in Colombia in order to apply for the Business Partner/Owner Visa, we offer a joint company incorporation and visa service, coordinating both processes from the start and taking into account the terms of your investment and the requirements that apply to the visa.
Minimum required investment: 100 SMMLV (COP 175,090,000 in 2026; between USD 50,000 and 60,000, depending on the exchange rate).

Can an S.A.S. have a single shareholder?
Yes. A Simplified Stock Company (Sociedad por Acciones Simplificada, S.A.S.) can be incorporated with a single shareholder, who may be an individual or a legal entity. You do not need several partners to create this type of company.
Can I incorporate an S.A.S. in Colombia if I am a foreigner?
Yes. A foreign individual can incorporate an S.A.S. in Colombia with a passport or foreign identification document, and a foreign company can do so with the documents that prove its existence and legal representation. Depending on the circumstances, it will be necessary to review the applicable requirements and the procedures related to foreign investment, where applicable.
Who can be the legal representative of an S.A.S.?
The legal representative can be an individual, Colombian or foreign, or even a legal entity acting through its own legal representatives. They may or may not be a shareholder. Their powers and limitations must be defined in the bylaws or in accordance with the rules set out there.
How long does it take to incorporate an S.A.S.?
Approximately two weeks from the filing of the registration request. Document preparation time is added to this, and the response times of the relevant entities and any requests or adjustments that arise during the process can also affect it. For that reason, the timeline should be assessed case by case.
What should I keep in mind after incorporating the S.A.S.?
Incorporation is the start of the company's legal obligations, not the end of the process. As a general rule, S.A.S. companies are required to keep accounting records, so having an accountant or accounting service is essential from the start. You must also renew the commercial registration (matrícula mercantil) every year, comply with corporate obligations, and obtain any permits or registrations the business activity requires.
How much does it cost to incorporate an S.A.S. in Colombia?
Registration costs are calculated based on the company's initial capital and the characteristics of the partners, for example, whether the youth entrepreneurship benefit applies. Legal fees are separate and depend on the scope of the service and the particulars of each case.
